Propublica Reveals Ginni Thomas Applauded Efforts by Right-Wing Group Working to Discredit Court Ethics Efforts

An explosive report from ProPublica today revealed that Ginni Thomas, the wife of Supreme Court Justice Clarence Thomas, sent an email thanking First Liberty Institute head Kelly Shackelford “so, so, so much” for the group’s efforts to obstruct anti-corruption measures for Supreme Court justices. Shackelford quoted Ginni Thomas saying that First Liberty’s efforts put wind in the “sails of many judges.” The First Liberty Institute has called itself “the largest legal organization in the nation dedicated exclusively to defending religious liberty for all Americans” and often has business before the Court, whose right-wing justices have recently ruled for First Liberty in major cases.
Although Justice Thomas has suggested that his wife’s political activities are not related to his role on the court, the email and Ginni Thomas’s work with right-wing groups suggest otherwise. In 2022, The New Yorker revealed that both Ms. Thomas and Shackelford were on the board of CNP Action—the political arm of the secretive and ultra right-wing Council for National Policy—while First Liberty was actively litigating cases before the Supreme Court. First Liberty is also a “coalition partner” for the Heritage Foundation’s Project 2025, a sweeping plan to impose a theocratic authoritarian vision of the United States in a second Trump administration. The MAGA-hijacked Supreme Court has already supported Project 2025’s authoritarian ambitions by gifting Donald Trump with a jaw-dropping decision inventing the notion that presidents have immunity for crimes committed in office as long as those crimes constitute “official acts,” despite the Constitution’s instruction that a president’s duty is to “faithfully execute” the laws. In that case, Justice Thomas refused to recuse himself, despite his wife having helped lead the so-called “Stop the Steal” movement to overturn the 2020 election results.
According to ProPublica’s report, “Shackelford said he saw Thomas’s support as evidence that judges, who ‘can’t go out into the political sphere and fight,’ were thankful for First Liberty’s work to block Supreme Court reform.” He also called Supreme Court Justice Elena Kagan “treasonous” and “disloyal” for expressing support for an enforceable code of ethics for the Court.
